Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MexiaHealth website located at mexiahealth.com and all related services provided by MexiaHealth ("Company," "we," "us," or "our"). By accessing our website or purchasing a concierge package, you agree to be bound by these Terms.

1. Nature of Our Services

MexiaHealth is a medical tourism concierge and care coordination service. We are not a healthcare provider, hospital, clinic, or medical practice. We do not diagnose, treat, cure, or prevent any disease or medical condition. Our services consist exclusively of:

  • Connecting patients with independent, licensed healthcare providers in Mexico City
  • Coordinating appointments, logistics, and communications
  • Providing translation, interpretation, and patient advocacy services
  • Offering general information about the Mexican private healthcare system
  • Facilitating travel, accommodation, and transportation arrangements

All medical decisions, diagnoses, treatment plans, and healthcare services are the exclusive responsibility of the licensed physicians and hospitals you engage through our network.

2. Eligibility

Our services are available to individuals aged 18 and over who have legal capacity to enter into binding agreements. By using our services, you represent that you meet these requirements. We reserve the right to refuse service to anyone at our sole discretion.

3. Concierge Packages — Scope and Limitations

Your purchased package provides access to coordination services only. Package fees are non-refundable once a case manager has been assigned and initial coordination has commenced. Medical procedure costs, hospital fees, physician fees, medication costs, and any other clinical expenses are entirely separate from and in addition to your MexiaHealth concierge package fee.

Important: MexiaHealth does not guarantee any specific medical outcome, surgical result, or clinical success. Results of medical procedures depend entirely on the individual patient's condition, the treating physician's judgment, and factors outside our control.

4. Payment Terms

All package fees are charged in United States Dollars (USD) and processed securely through Stripe. By completing a purchase, you authorize the charge to your provided payment method. Prices are subject to change; changes do not affect packages already purchased.

5. Intellectual Property

All content on this website — including text, graphics, logos, images, and software — is the property of MexiaHealth and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

6. Limitation of Liability

To the maximum extent permitted by applicable law, MexiaHealth shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, your interaction with any healthcare provider in our network, or any medical procedure undertaken as a result of our coordination. Our total aggregate liability shall not exceed the amount you paid for your concierge package.

7. Governing Law

These Terms are governed by the laws of Mexico City (Ciudad de Mexico), Mexico. Any dispute arising from these Terms shall first be subject to good-faith negotiation, then mediation, and finally binding arbitration conducted in Mexico City. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last Updated" date on this page and, for active patients, by email notification to the address on file.

Privacy Policy

MexiaHealth is committed to protecting the privacy and security of your personal and health information. This Privacy Policy explains what information we collect, how we use it, and your rights regarding that information.

Information We Collect

  • Contact information: Name, email address, phone number, country of residence
  • Health information: Medical specialty interest, current condition descriptions, medical history shared voluntarily through intake forms
  • Payment information: Processed exclusively through Stripe; we do not store credit card numbers
  • Communications: Records of email exchanges, WhatsApp messages, and consultation notes
  • Technical data: IP address, browser type, pages visited (via server logs only; no analytics tracking currently deployed)

How We Use Your Information

  • To coordinate your care and communicate with healthcare providers on your behalf
  • To process payments and send transaction confirmations
  • To send service-related communications and, if opted in, our newsletter
  • To improve our services and website
  • To comply with legal obligations

Data Sharing

We do not sell your personal data. We share your information only with:

  • Healthcare providers you authorize us to contact on your behalf
  • Stripe for payment processing (governed by Stripe's Privacy Policy)
  • Legal authorities when required by law

Data Retention

We retain personal data for as long as necessary to provide our services and comply with legal obligations, typically no longer than 7 years after your last interaction with our service.

Your Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or port your personal data. Contact privacy@mexiahealth.com to exercise these rights.

HIPAA Notice of Privacy Practices

Important Notice: MexiaHealth is a concierge coordination service, not a Covered Entity under the Health Insurance Portability and Accountability Act (HIPAA) as defined under 45 CFR Parts 160 and 164. However, we voluntarily adopt HIPAA-equivalent privacy standards for all Protected Health Information (PHI) we handle on your behalf, and we contractually require the same of our network partners.

What Is Protected Health Information (PHI)?

PHI includes any individually identifiable health information we receive, create, or maintain on your behalf, including information about your past, present, or future physical or mental health conditions, the healthcare services provided to you, and payment for those services.

How We Handle Your PHI

We use and disclose your PHI only in the following circumstances:

  • Treatment coordination: To communicate with physicians, hospitals, and specialists in our network who will provide or evaluate your care
  • Operations: Internal quality review and case management activities necessary to coordinate your care
  • With your written authorization: Any other use or disclosure not described here requires your explicit written consent
  • As required by law: Disclosures required by applicable Mexican or U.S. law

Your HIPAA-Equivalent Rights

Right to Access

Request and receive a copy of your PHI and care coordination records held by MexiaHealth within 30 days of your request.

Right to Amend

Request corrections to your health information if you believe it is inaccurate or incomplete.

Right to Restrict

Request restrictions on how we use or disclose your PHI, though we are not always required to agree to your request.

Right to Accounting

Request a list of disclosures of your PHI we have made in the past six years, excluding disclosures for treatment and operations.

Right to Confidential Communication

Request that we communicate with you by specific means — e.g., only via encrypted email or only to a specific phone number.

Right to Complaint

File a complaint with us or with the U.S. Department of Health and Human Services if you believe your privacy rights have been violated.

Security Safeguards

We implement the following administrative, physical, and technical safeguards to protect your PHI:

  • All data transmissions are encrypted using TLS 1.2 or higher (HTTPS)
  • Database access is restricted to authorized personnel only
  • PHI shared with healthcare providers is transmitted via encrypted channels
  • Staff with access to PHI are bound by confidentiality agreements
  • We maintain incident response procedures for any unauthorized disclosure

Breach Notification

In the event of a breach of unsecured PHI, we will notify affected individuals within 60 days of discovery of the breach, consistent with HIPAA Breach Notification Rule standards (45 CFR §164.400).

Cost and Pricing Information

All procedure cost ranges and price comparisons published on this website are approximations based on publicly available data and general market information. Actual costs depend on individual clinical circumstances, the specific provider chosen, implant or material selection, length of stay, and other factors. MexiaHealth does not guarantee that any procedure will be available at the prices described.

Medical Tourism Risks

Seeking medical care abroad involves inherent risks that patients should fully consider before proceeding, including but not limited to:

  • Complications from international travel proximate to surgical procedures
  • Risk of deep vein thrombosis (DVT) associated with air travel post-surgery
  • Limited continuity of care after returning to your home country
  • Potential difficulties with follow-up care and complication management at home
  • Differences in legal recourse compared to your home jurisdiction

We strongly encourage all patients to consult with their primary care physician before undertaking any medical procedure abroad and to obtain comprehensive travel health and medical evacuation insurance.

What Cookies We Use

Our website currently uses a limited set of cookies:

  • Strictly Necessary — Stripe.js: When you access the payment section of our site, Stripe's JavaScript library sets functional cookies required for secure payment processing and fraud prevention. These cookies are essential to the checkout process and cannot be disabled without disabling payments entirely. They are governed by Stripe's Privacy Policy.
  • Preference cookies (first-party): We store your cookie consent preference and your dismissal of promotional banners in your browser's localStorage. No personal data is stored in these items.

What We Do NOT Use

  • Facebook Pixel or advertising/retargeting cookies (not currently installed)
  • Session recording tools such as Hotjar or FullStory
  • Third-party advertising networks
